The Contra Costa County Bar Association, Family Law Section Presents a Two-Part Series on Domestic Violence Temporary Restraining Orders

Panelists:

Part I – October 12, 2022, 12:00 p.m.
In the first session of this series, we will review the different types of restraining orders that can be issued to protect a survivor and discuss common issues that arise before judges when applying for such an order. This presentation will describe the law and procedures for filing TROs, as well as a discussion of the process and procedures for applying for TROs, including the nuances as to various types of abuse and the best practice for presenting evidence of such in the initial request. We also review the crossover issues between domestic violence, civil harassment, and elder abuse restraining orders.

Part II – October 26, 2022, 12:00 p.m.
Within this session, we will review the procedure of preparing for and arguing at the long cause hearing for the Restraining Order After Hearing. We will discuss what constitutes a violation of the restraining order as well as the effect of a finding domestic violence has been committed on custody.
