After an accomplished legal career spanning four decades, Judge McAdam joined ADR Services, Inc. to assist parties and their lawyers in the resolution of their legal disputes and to bring peace to their lives. Judge McAdam will provide his expertise in the areas of Family Law and Construction Law. He is available to conduct mediations, arbitrations, settlement conferences and all types of civil proceedings. If requested, he will serve as a private judge in accordance with Article VI.

Judge McAdam graduated from the University of California, Berkeley, with an undergraduate degree in Economics and received his Juris Doctor from Loyola Law School in Los Angeles. After passing the California bar exam, he reported for Active Duty with the United States Marine Corps. Judge McAdam served as a Captain in Vietnam and was a decorated combat infantry officer, serving as a company commander of an infantry rifle company.

After returning to the United States from Vietnam, Judge McAdam began his law career in 1969 as a legal officer at the Marine Corps Recruit Depot in San Diego. From 1970 to 1976, he practiced general and civil litigation with the law firm of McAdam & Neil, and later with the law firm of Jones, Tellam, Irving & Estes. In 1976, he moved to Idaho, where he practiced general and civil litigation. He then returned to San Diego in 1988 and worked as In-House Counsel for Lusardi Construction Company, handling numerous Construction related matters. Three years later, he joined Gordon & Rees, where he handled Insurance defense cases and all types of Construction and Construction Defect matters.

Prior to his appointment to the bench, Judge McAdam served as a full-time Judge Pro Tem at the San Diego Juvenile Court, where he presided over Juvenile Delinquency and Dependency cases. He also chaired the Drug Court Steering Committee and the Delinquency and Truancy Subcommittees.

Appointed by former Governor Gray Davis, Judge McAdam began his judicial career in 2003. Driven by his earlier experiences working with families and juveniles at the Juvenile court, Judge McAdam chose to spend the majority of his time on the bench in Family Law assignments. During his tenure, he presided over some of the court’s toughest child custody, support, and asset evaluation cases, while approaching each case with a concern and compassion for the individuals involved.

FAMILY LAW

  • Handled challenges to marital settlement agreements, including out-of-state and out-of-country agreements regarding complex financial matters, custody and visitation arrangements, and support issues.
  • Handled numerous contested child custody matters with visitation restrictions, child support and fees.
  • Presided over numerous custody and visitation disputes. Issues included high conflict cases with significant issues of parent alienation; abuse allegations; inter-state, and intra-state move-away requests; and school choice issues.
  • Resolved dozens of complex property issues including the character, value and division of property.
  • Dealt with high-value, complex, financial disputes, including determining validity of inter-spousal transfers and quit claims, imputation of income, pre-judgment liquidation of assets to avoid unreasonable market risks, characterization and valuation of businesses, apportionment of mixed-character properties, Watts charges and Epstein credits, and apportionment and characterization of stock options.
  • Handled multiple child custody and visitation matters presenting issues of high conflict breakup, parental alienation, and estrangement.
  • Handled dozens of cases regarding appointment of retirement accounts, including 401k, 457b, IRAs, and QDROs.
  • Handled cases involving date of separation, validity and enforceability of pre- and post-marital agreements, clarification of prior court orders and agreements, and failure to disclose assets.
  • Presided over numerous child support, spousal support, and attorney fee requests. Issues included self-employment and income tax write-offs, cash wages, investment and rental income, stock options, depreciation, family gifts, loans, disability, vocational evaluations, and imputed income.
  • Addressed liquidation and distribution of assets from the sale of various assets including homes, investment properties, and businesses in dozens of cases.
  • Presided over numerous validities of premarital agreement matters, including interpretation of the agreement, spousal support, division of substantial jointly-owned assets and fees. Spousal support required determination and consideration of marital standard of living.
