SUMMARY:Bringing a Government Tort Action: A Practice Guide
DESCRIPTION:Description: \nNavigating government tort claims in California requires precision\, strategy\, and a deep understanding of the Government Claims Act. From strict claim-presentation deadlines to nuanced distinctions between negligence and dangerous dangerous cases and the applicable law\, even experienced litigators can find themselves tripped up by the statutory requirements and appropriate CACI’s to pubic entity defendants.   \nThis comprehensive CLE program demystifies the process of bringing a government tort action and provides a practical roadmap for attorneys handling claims against cities\, counties\, and other public entities. Participants will learn when a government tort claim is required\, how to properly present it\, and how exceptions\, tolling\, and late-claim procedures operate. The program will also explore the interplay between tort theories—including negligence\, dangerous condition of public property\, and professional negligence—and the corresponding statutory framework that governs liability\, notice\, and immunities. \nSpeakers: \n\nHon. Victoria Chaney (Ret.) – ADR Services\, Inc.\nMichael Nebenzahl\, Esq. – ADR Services\, Inc.\n\nLocation: \nZoom Webinar \nCost: \n$0 – Complimentary Program \nWritten Materials >>> \nHandout Materials >>>

SUMMARY:What I Wish the Other Side Knew
DESCRIPTION:Description:\nCo-Sponsored by the Women in Trial Travel Summit\, What I Wish the Other Side Knew pulls back the curtain on what really matters to each participant in mediation. \nIn this candid\, practitioner-driven program\, seasoned panelists include plaintiff’s attorney Michelle West\, defense attorney Wilma Gray\, and mediator Debra Bogaards (who has a background representing both sides). The panel will share the insights they rarely get to say out loud—what they need\, what they worry about\, and what helps (or hurts) the path to resolution. \nThe panel explores critical moments before and during mediation\, including effective briefing and information exchange\, navigating layered insurance coverage and multiple parties\, addressing ability-to-pay issues and bankruptcy realities\, and preparing clients for the emotional and strategic “day in court” experience. The discussion concludes with practical strategies for crafting creative\, sometimes non-monetary settlement terms that move cases forward when money alone isn’t enough. \nDesigned for attorneys on both sides of the aisle\, this program offers practical perspective-shifting insights that can lead to more productive mediations—and better outcomes for clients. \nSpeakers: \n\nDebra Bogaards\, Mediator – ADR Services\, Inc.\nMichelle West\, Plaintiff’s Counsel – Robinson Calcagnie\nWilma Gray\, Defense Counsel – McNamara\, Ambacher\, Wheeler\, Hirsig & Gray LLP\nLauren Wood\, Moderator – L Woods Law & WITTS Founder\n\nLocation:\nZoom Webinar\n \nCost:\n$0 – Complimentary Program \nHandout >>>

SUMMARY:Mediating Wrongful Eviction & Habitability Claims: The Dynamic Interplay between Tenants\, Landlords and Carriers
DESCRIPTION:Description:\nMediation of affirmative tenant claims are never just two-sided disputes — they are multi-layered negotiations shaped by local eviction control ordinances\, insurance coverage issues\, and the value of the tenancy. \nJoin Steve Abern (Mediator/Panel Counsel)\, Jacqueline Ravenscroft (Plaintiff’s Counsel)\, and Jeff Woo (Personal Counsel) for a candid\, practical discussion of who’s really in the room — and how their roles intersect before and during mediation. \nThis program moves beyond generic mediation advice to focus on the players and their interplay: panel counsel\, personal counsel\, claims representatives\, and plaintiff’s counsel. Through real-world habitability and wrongful eviction case examples\, the panel will explore preparation and case evaluation\, insurance coverage issues\, attorney’s fees\, statutory penalties\, potential tenancy buyouts\, and the optics that influence carrier decision-making. \nAttendees will gain a clearer understanding of how each role evaluates risk\, communicates with carriers\, navigates authority\, and shifts strategy at mediation — and how to work more effectively across the aisle to reach resolution. \nSpeakers: \n\nSteve Abern – ADR Services\, Inc.\nJacqueline Ravenscroft – Tobener Ravenscroft\nJeffery Woo – Womble Bond Dickinson LLP\n\nLocation:\nZoom Webinar\n \nCost:\n$0 – Complimentary Program \nHandout Materials – Glossary of Roles & Terms >>>

SUMMARY:The Construction Dispute Summit: Killing the "Billing Event" and Mastering the High-Stakes End Game
DESCRIPTION:Description:\nConstruction litigation in California has reached a critical crossroads where complex multi-party disputes often devolve into aimless\, expensive “billing events” rather than structured paths to resolution. This marquee panel brings together an elite class of neutrals and practitioners from JAMS\, AAA\, and ADR Services to dismantle these inefficiencies and provide a definitive roadmap to the “End Game.” Moving far beyond “Mediation 101\,” this session explores the tactical preparation\, risk transfer nuances\, and the 2026 digital divide of Zoom versus in-person negotiations required to break insurance logjams. Attendees will learn to shift their mindset from merely attending a session to aggressively driving a resolution through diligent investigation and sophisticated deal-structuring\, replacing procedural “drift” with a disciplined\, high-velocity approach to settlement. \nSpeaker: \n\nBob Friedenberg\, Esq. – ADR Services\, Inc. & Others \n\nLocation:\nOCBA Headquarters\, 4101 Westerly Place\, Newport Beach\, CA 92660\n \nCost:\nTBA

SUMMARY:Understanding California’s Labor Code §2699.3 and PAGA ENE: Procedure\, Practice & Impact
DESCRIPTION:Description:\nCalifornia Labor Code §2699.3 has altered the procedural path of PAGA litigation by introducing a statutory Early Neutral Evaluation (ENE) process that\, in practice\, often functions as an early mediation. \nThis program will break down the statute’s language and legislative origins\, outline the ENE timeline and hearing procedure\, and examine how courts are implementing the process. The panel will then turn to real-world application: Does ENE meaningfully change outcomes? How flexible are the statutory timelines? And why do many cases ultimately resemble traditional mediation? \nFinally\, the discussion will explore broader implications for employers\, employees\, and the courts — including pending regulations\, the anticipated California Supreme Court decision in Leeper v. Shipt\, Inc.\, and the political and budgetary forces shaping PAGA’s future. \nAt bottom\, this program discusses the real-world implications of this procedural reform\, and what the future may hold for PAGA litigation. \nSpeakers: \n\nHon. SUMMARY:The Insurance Universe Post-Pinto v. Farmers (2021)
DESCRIPTION:Description:\nThe Pinto decision upended long-standing assumptions in California insurance litigation\, directly challenging the validity of CACI 2334 and setting off a wave of change across bad faith failure-to-settle claims. In response\, courts and legislators acted—producing two significant published opinions and ushering in Code of Civil Procedure § 999\, which now governs pre-litigation settlement demands. \nIn this program\, mediator and retired Judge Vedica Puri will unpack: \n\nWhat Pinto really changed about bad faith litigation;\nHow recent decisions like Hedayati and Planet Bingo extend or limit that reasoning;\nWhy CACI 2334 had to be revised—and what the new instruction means for trials;\nHow CCP § 999 is reshaping settlement strategies and potential liability.\nWhether you represent plaintiffs\, defend insurers\, or mediate coverage disputes\, this program will help you understand and adapt to the new legal landscape\n\nSpeaker: \n\nHon. SUMMARY:What Every Construction Lawyer Should Know about Mandatory Mediation Under SB 440
DESCRIPTION:Description:\nWith the enactment of SB 440\, owners\, contractors and subcontractors and their counsel must now navigate a mandatory claim dispute process defined by newly-enacted SB 440 (Civ.
