SUMMARY:Top Five Critical Lessons from Mediators of Trust and Estate Disputes
DESCRIPTION:Description:\nJoin a panel of five esteemed mediators of trust and estate disputes including Honorable James P. Gray (Ret.)\, Honorable Jamoa A. Moberly (Ret.)\, Honorable Glen M. Reiser (Ret.)\, and Bette Epstein\, Esq.\, together with moderator Kristin Yokomoto\, Esq. as we explore the intricacies of successful mediations. Trust and estate litigation is on the rise and so are the number of disputes being successfully resolved outside of the courtroom through mediation. Unlike other types of disputes\, trust and estate fights often involve the break-down of family relationships over inheritances. These experienced mediators will discuss the top five critical lessons on dealing with challenges of mediating trust and estate disputes including the (1) importance of advanced preparation by the lawyers and mediator and well prepared pre-mediation briefs\, (2) role of the disputants’ understanding of mediation and how mediators can help establish realistic expectations during the mediation\, (3) standards of conduct for mediators and mediation confidentiality\, (4) differences between evaluative and facilitative mediation styles and the time and place for a mediator’s proposal to progress through an impasse\, and (5) hidden forces that shape a disputant’s decisions and dealing with high conflict personalities. They will also share touching stories about apology and the opportunities to help families build bridges to be able to potentially reconnect with each other. \nInteract with the Mediators: The presentation will allow time for attendees to interact with these top trust and estate mediators who contribute to helping resolve these complex family disputes. \nSpeakers: \n\nBette Epstein\, Esq. – ADR Services\, Inc.\nHon. SUMMARY:Negotiating and Settling Tort Cases: Evaluating the Case\, Making the Demand\, Bargaining Directly or in Mediation
DESCRIPTION:Description:\nThe reality is that most lawsuits settle. Thus\, just as every case should have trial themes and discovery strategies\, each one should have a settlement plan and strategy. But most lawyers mistakenly assume that what persuades a jury will persuade opposing counsel or meet the needs of the defendant’s insurers\, who may or may not be present\, and whose checkbooks will fund the settlement. An overall settlement strategy needs to be developed based on numerous obvious and not-so-obvious factors. Although the parties may frequently be attempting to divide a fixed sum\, such as the defendant’s insurance proceeds\, some options may exist to expand the pie or the people adding to it.\nListen as this premier panel of experienced negotiators and litigators offers guidance on practical actions that personal injury attorneys can take to make their opponents more receptive to their proposals. \n\nSpeakers: \n\nStacie Feldman Hausner\, Esq.\, Mediator – ADR Services\, Inc.\nGuy O. This event will feature a full day of MCLE programming covering all of the hard to get “special” credits – four (4) hours of Legal Ethics\, one (1) hour of Competence\, one (1) hour of general Elimination of Bias\, and one (1) hour of Elimination of Bias with Emphasis on Implicit Bias. As a bonus\, we will also feature a one (1) hour general credit session. Attend one session\, or all! \nSpeakers:\n \n\nRobert Hamilton\, Esq. & Mark LeHocky\, Esq.\n9:00 a.m. – 10:00 a.m. – Competence\nNurturing Resilience: Mental Health in the Legal Profession \nOver 40% of employees globally report that they are stressed\, and this figure is even higher in the legal industry\, a profession well-known for stressors such as tight deadlines\, high conflict and overbearing workloads. Failures to address these issues before they metastasize further can lead to increasingly bad mental health and diminished competence as an attorney. In this program\, we will explore sources of mental health challenges and identification of incompetence both in yourself and others. \nWritten Material\n \nCarmen Alberio\, Esq.\, Ed Weiss\, Esq. & Chris White\, Esq.\n10:10 a.m. – 12:10 p.m. – Ethics\nLegal Ethics In An Evolving Landscape \nThe legal landscape is constantly evolving. Embark on a dynamic exploration of the shifting legal landscape in this Legal Ethics Program\, where we delve into the latest developments transforming the practice of law. From the integration of technology in the courtroom to enhanced reporting requirements and the blurred lines between virtual and real life\, this program is designed to equip legal professionals with the knowledge and ethical guidelines necessary to navigate these contemporary challenges. \nWritten Material\n \nGeri Green\, Esq. & Margaret Levy\, Esq.\n12:20 p.m. – 1:20 p.m. –Implicit Bias \nBias Disrupters: Implicit Bias in Mediation \nBiases\, especially implicit biases\, are unavoidable. We all make snap assessments every day of our lives. Some of these assessments\, however\, in a mediation context may serve to undermine confidence in the legal system. In this program\, we will explore different types of implicit biases\, how they may manifest throughout the process of dispute resolution\, and most especially how you can harness the power of time to reduce their impact. \nWritten Material\n \nHon. Craig Karlan (Ret.)\n1:40 p.m. – 2:40 p.m. – General \nLaw & Motion: The Truth\, the Whole Truth\, and Nothing but the Truth – A Perspective from the Bench \nThis program will focus on the art of persuasion\, the “Dos and Don’ts” of law and motion. Tune in to learn everything you ever wanted to know about law and motion but were too afraid to ask. \nHaving served as an Independent Calendar Judge in the Los Angeles West District for over 14 years\, ruling on upwards of 7\,500 motions\, if not more\, with as many as 730 general jurisdiction cases assigned to him at one time\, recently retired Judge Karlan has handled a complex and complicated law and motion calendar under a variety of circumstances and time constraints. \nIn this program Judge Karlan will provide insight from his over twenty years on the bench\, including motions to quash\, demurrers\, motions to strike/anti-SLAPP motions\, MSJs\, electronic service\, discovery and motions in limine. HOWEVER\, beyond the technical legal requirements\, successful motion practice requires careful crafting\, a compelling argument and attention to detail. It also involves thinking of and paying attention to your Judge\, both with respect to what you submit and how you argue. \nWritten Material \nHon. Chester Horn (Ret.) & Richard Segal\, Esq.\n2:50 p.m. – 3:50 p.m. – Elimination of Bias\nGetting Rid of Bright Lines: Advancing Equity in the Legal Profession \nEach case is different\, and may benefit from a different attorney – one with shared experience with a client; one with specific background expertise; one with a certain personality or affect. In order to find the best fit for each case\, law firms need to examine their hiring practices and consider prospective sources of bias. In this program\, we will look at possible biasing elements in the hiring process\, how to reduce their impact\, and the numerous benefits both in court and in mediation\, or maintaining a diverse workforce in the legal profession. \nWritten Material\n \nJeanne Behling\, Esq.\, Sanford Jossen\, Esq. & Steve Sepassi\, Esq.\n4:00 p.m. – 6:00 p.m. – Ethics \nNavigating Ethical Waters: A Dive into Legal Ethics in Mediation \nHow do legal ethics apply to mediation and alternative dispute resolution? This program will explore this question. From reporting requirements\, exceptions\, confidentiality and privilege\, to the duty of diligence and competence and how those apply in mediation\, our speakers will provide insight into a lawyer’s ethical obligations\, along with real-world applications of these issues to gain practical knowledge. \nWritten Material\n \n\nMCLE:\nEach day will offer 8 hours of Participatory MCLE Credit: \n\nFour (4) hours Legal Ethics\nOne (1) hour Competence\nOne (1) hour Elimination of Bias\nOne (1) hour Implicit Bias\nOne (1) hour General Credit\n\nLocation:\nZoom Webinar

SUMMARY:Practical Considerations for Class Action Settlements\, from Negotiation to Final Court Approval
DESCRIPTION:Description:\nLitigating the disputes of large numbers of people simultaneously using the class action rules bring special challenges for all parties involved. SUMMARY:6309 Is Now The Law…Now What?
DESCRIPTION:Description:\nNew Family Code section 6309 ends a longstanding controversy (yes\, civil discovery is permitted in DVPA proceedings) but we now confront a host of new controversies generated by the statute. Some practitioners see section 6309 as a long overdue clarification and expansion of DVRO discovery rights; others see it as a welcome\, or unwelcome\, significant contraction.  Some see it as a risk of revictimization via discovery abuse while others see it protecting against that risk. Who’s right? Probably everyone to some degree. This much for sure: the statute’s unique provision\, permitting discovery to be requested only at the evidentiary hearing and not before\, is something totally new to practitioners. How will judges interpret the statute? How does it apply to “cross-over” situations where a DV petition is filed in an extant disso or parenting case? What are best practices?  What are the collateral effects under FC sections 3044 and 4320? Join our expert panel\, including LA Superior Court judges Lawrence Riff and Susan Lopez-Giss (ret’d)\,  and practitioner Michael Hanasab\, who will cover the basics of section 6300\, practitioners” and judicial officers’ challenges and dilemmas\, and possible best practices. This program will be focused towards family law practitioners. \nSpeakers: \n\nHon. Susan Lopez-Giss (Ret.) – ADR Services\, Inc.\nHon.
